Scope of application
The following terms and conditions apply to all orders placed via our online store. Our online store is aimed exclusively at consumers.
Consumers are consumers in the sense of the Consumer Protection Act (KSchG) and thus natural or legal persons who are not entrepreneurs.
Contracting party, conclusion of contract, correction possibilities
The contract of sale is concluded with Battle The Beach UG.
The presentation of the products in the online store is not a legally binding offer, but a non-binding online catalog. You can place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained for this purpose in the order process. By clicking the order button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of your order will be sent by e-mail immediately after sending the order.
When the contract with us is concluded depends on the method of payment you have chosen:
We accept your order by sending a declaration of acceptance in a separate e-mail or by delivering the goods within three days.
We accept your order by sending a declaration of acceptance in a separate e-mail within two days, in which we give you our bank details.
You are redirected to Apple, enter your payment details and confirm the payment instruction. After submitting the order we request Apple to initiate the payment transaction and thereby accept your offer.
By submitting the order you provide your credit card details and the credit card company performs an authorization check. Your card is charged when you place the order — at that moment the contract is concluded.
With the submission of the order you give BillPay a direct debit mandate. BillPay informs you about the date of the debit within two days after receipt of your order (prenotification). Thereby the contract comes into effect.
You are redirected to PayPal, enter your payment details and confirm the payment instruction. After submitting the order we request PayPal to initiate the payment transaction and thereby accept your offer.
After placing the order you are redirected to Sofort GmbH, where you confirm the payment instruction. Thereby the contract comes into effect.
After placing the order you are redirected to your bank or to paydirekt, where you confirm the payment instruction.
You are redirected to Google, enter your payment details and confirm the payment instruction. After placing the order we request Google to initiate the payment transaction.
You are redirected to Amazon before completing the order, select the delivery address and payment method stored there and confirm the payment instruction. Afterwards you return to our store to complete the order.
You pay the invoice amount in cash upon pickup.
Contract language, contract text storage
The language available for the conclusion of the contract is German.
We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.
Delivery conditions
In addition to the stated product prices, shipping costs may be incurred. You can find out more about any shipping costs in the offers.
In principle, you have the option of collection from Battle The Beach UG, to be found at CrossFit Sturmflut, Erich-Schlesinger-Str. 62, 18059 Rostock, Germany, during the specified business hours of CrossFit Sturmflut.
Payment
In our store, the following payment methods are generally available:
We tell you our bank details in a separate e-mail and deliver the goods after receipt of payment.
You pay the purchase price directly to the deliverer. There is an additional charge of 4,00 Euro.
After your legitimation as a legitimate cardholder the payment transaction is carried out automatically and your card is charged.
After a successful address and credit check you issue a SEPA direct debit mandate to BillPay and we assign our claim to BillPay. The account is debited before the goods are shipped. In addition to our T&Cs, the T&Cs and privacy policy of BillPay apply.
To pay via PayPal you must be registered there, legitimize with your access data and confirm the payment instruction. The payment transaction is carried out automatically by PayPal immediately afterwards.
Within the PayPal Plus payment service we offer various payment methods as PayPal services — PayPal balance, credit card, direct debit or invoice. For purchase on account we assign our claim to PayPal after a successful address and credit check.
You need a bank account activated for online banking, identify yourself accordingly and confirm the payment instruction. The payment transaction is carried out immediately afterwards.
You must use the Safari browser, be registered with Apple, have activated Apple Pay, legitimize yourself and confirm the payment instruction.
You must be registered with Google, have activated Google Pay, legitimize yourself and confirm the payment instruction.
You need a bank account activated for online banking, identify yourself accordingly and confirm the payment instruction to us.
You need an online banking account activated for paydirekt, legitimize yourself with your access data and confirm the payment instruction to us.
You must be registered with Amazon, select the delivery address and payment method stored there and confirm the payment instruction. Immediately after shipping we request Amazon to initiate the payment transaction.
In cooperation with Klarna AB, Sveavägen 46, Stockholm, Sweden. Klarna invoice is only available to consumers and payment must be made to Klarna. You always get the goods first and always have a payment period of 14 days.
Pay flexibly in monthly installments of at least 1/24 of the total amount (minimum € 6,95). Klarna installment purchase is only available to consumers and payment must be made to Klarna.
You pay the invoice amount in cash upon pickup.
Reservation of proprietary rights
The goods remain our property until full payment.
Transport damages
If goods are delivered with obvious transport damage, please claim such defects as soon as possible to the deliverer and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.
Warranty and guarantees
The statutory law on liability for defects shall apply. Information on any applicable additional warranties and their exact conditions can be found with the product and on special information pages in the online store.
Liability
For claims based on damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation in case of injury to life, body or health; in case of intentional or grossly negligent breach of duty; in the case of warranty promises, insofar as agreed; or insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.
Dispute resolution
The European Commission provides a platform for online dispute resolution (OS). We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
